New Procedure for Emergency and Ex Parte Requests
Requests for emergency and ex parte relief* shall be filed with the civil clerk's office on the first floor of the Circuit Court. All parties must comply with the provisions of Maryland Rule 1-351(b). The Court generally requires 24 hours advance notice to all interested parties unless circumstances preclude such notice. It is required that emergency and ex parte requests, upon proper notice, shall be presented ONLY on Mondays, Wednesdays and Fridays at 1:30 p.m. The Court will no longer consider these requests if presented on Tuesdays and Thursdays. Motions for Emergency Relief will be heard by a Master of the family law division on Mondays, Wednesdays and Fridays at 1:30 p.m. The hearings will occur in the designated Master's hearing room where testimony may be taken before a decision is rendered. The criteria for obtaining emergency relief requires a showing that there is an imminent risk of substantial and immediate physical harm to a party or minor child. The Family Law Self Help Center, located on the second floor of the Circuit Court, has the appropriate motion and notice forms for an emergency and ex parte request. The Center is open Mondays, Wednesdays and Thursdays from 9:00 a.m. until 4:30 p.m. and on Tuesdays and Fridays from 9:00 a.m. until 12:00 p.m.
